Paparazzi Jewelry Lawsuit
In the spring of 2014, a jewelry company by the name of Paparazzi filed a lawsuit against another jewelry company, Kendra Scott, for allegedly stealing its designs. Paparazzi claimed that Kendra Scott had copied several of its designs, and that the copied designs were being sold on Kendra Scott’s website.
The lawsuit was a high-profile one, garnering a great deal of media attention. It was also a complex one, as it involved several different legal theories.
Paparazzi’s main argument was that Kendra Scott had violated the Copyright Act. Under the Copyright Act, an individual or company can protect its original works of authorship, such as designs or photographs, by registering them with the Copyright Office.
Once a work is registered with the Copyright Office, the owner of the work has the exclusive right to reproduce, distribute, and/or display the work. This means that no one else can copy the work without the owner’s permission.
In this case, Paparazzi had registered its designs with the Copyright Office, and it argued that Kendra Scott had copied those designs without permission. As a result, Paparazzi asked the court to order Kendra Scott to stop selling the copied designs.
Kendra Scott argued that the designs were not protected by copyright law. Specifically, Kendra Scott claimed that the designs were not original enough to qualify for copyright protection.
To qualify for copyright protection, a work must be original, meaning that it must be the author’s own creation. It cannot be a copy or a variation of someone else’s work.
